Welcome to Black Ass Coffee Company. These Terms of Service ("Terms") govern your access to and use of the Black Ass Coffee Company website, online store, products, services, and related features (collectively, the "Services").
By accessing our website, placing an order, or purchasing products from us, you agree to these Terms and our applicable policies, including our Privacy Policy and Return & Order Issue Policy.
If you do not agree with these Terms, please do not use our Services.
SECTION 1 — ELIGIBILITY AND ACCOUNT INFORMATION
By using our Services or placing an order, you represent that you are legally permitted to enter into a purchase transaction under the laws applicable to you.
When using our Services or placing an order, you may provide information such as your:
- Name
- Email address
- Phone number
- Billing information
- Payment information
- Shipping address
You agree that the information you provide is accurate, current, and complete.
You are responsible for reviewing your information carefully before submitting an order, particularly your shipping address and product selections.
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
SECTION 2 — OUR PRODUCTS
We make reasonable efforts to ensure that product descriptions, photographs, prices, sizes, roast information, ingredients, and other product information displayed on our website are accurate.
However, coffee is a natural product, and characteristics such as flavor, aroma, appearance, and other qualities may vary between batches.
Product images may also vary from the actual product because of photography, screen settings, lighting, packaging changes, and other factors.
We reserve the right to:
- Change product descriptions or specifications.
- Change prices.
- Discontinue products.
- Limit product quantities.
- Correct errors or inaccuracies.
- Change product availability.
- Refuse or limit orders where necessary.
Product availability may change without notice.
SECTION 3 — COFFEE IS ROASTED TO ORDER
Our coffee is roasted to order in small batches.
Orders are custom prepared after they are received. Coffee is roasted, packed, labeled, and prepared for shipment as part of our fulfillment process.
Because our coffee is prepared specifically for each order, coffee products are not eligible for ordinary returns.
If there is a problem with your coffee order, please contact us rather than sending the coffee back.
SECTION 4 — ORDERS AND ORDER ACCEPTANCE
When you place an order through our website, you are submitting a request to purchase the products included in your order.
An order confirmation does not necessarily mean that Black Ass Coffee Company has accepted every aspect of the order.
We reserve the right to refuse, cancel, or limit an order for reasons including:
- Product availability
- Pricing or listing errors
- Incorrect customer information
- Suspected fraudulent activity
- Shipping limitations
- Unusual or excessive quantities
- Other circumstances requiring an order to be cancelled or modified
If we cancel an order after payment has been received, we will refund the amount charged for the cancelled portion of the order.
Please carefully review your order before completing checkout.
Once an order has entered processing or fulfillment, we may not be able to cancel or modify it.
SECTION 5 — ORDER CHANGES
If you need to change an order, contact us as soon as possible.
Once an order has entered fulfillment or has already been fulfilled, changes may no longer be possible.
Please carefully check your:
- Shipping address
- Coffee selection
- Grind selection
- Quantity
- Other order details
before completing your purchase.
Changes made to information in your Shopify store after an order has entered fulfillment may not change the fulfillment order already being processed.
SECTION 6 — PRICES, TAXES AND PAYMENT
All prices are displayed in U.S. dollars unless otherwise stated.
Prices, promotions, discounts, product availability, and other pricing information may change without notice.
The price charged for an order will generally be the price displayed at checkout when the order is placed.
Applicable taxes and shipping charges may be added at checkout.
Promotional offers may have additional terms and conditions. If specific promotion terms conflict with these Terms, the specific promotion terms will apply to that promotion.
You agree to provide accurate billing and payment information and represent that you are authorized to use the payment method provided.
SECTION 7 — SHIPPING AND PROCESSING
Our coffee is roasted to order, meaning orders require processing before they are shipped.
Orders are generally processed for roasting within approximately 2–4 business days, with processing commonly taking 2–3 business days during much of the year. Processing may take longer during peak periods and holidays.
After processing, orders are generally delivered within approximately 1–4 business days, depending on the destination, order size, and carrier.
As a general guideline, total order-to-delivery time is therefore commonly approximately 2–5 business days for processing and shipment plus applicable delivery time, depending on when the order is placed and other circumstances.
Delivery times are estimates and are not guaranteed.
Orders may be shipped using carriers including:
- USPS
- UPS
- FedEx
The shipping method and carrier may vary depending on the order, destination, package, cost, and other fulfillment considerations.
SECTION 8 — SHIPPING DELAYS
Delivery times may be affected by circumstances outside our reasonable control, including:
- Carrier delays
- Weather
- Holidays
- Incorrect or incomplete shipping information
- Operational disruptions
- Other circumstances affecting transportation or delivery
Tracking information may initially show an order as "pre-shipment" even though the order has been prepared for shipment.
Carrier tracking information may take time to update after an order has been processed.
We do not guarantee a specific delivery date.
SECTION 9 — SHIPPING ADDRESSES
Customers are responsible for providing a complete and accurate shipping address.
If an order cannot be delivered because an incorrect or incomplete address was provided, the customer may be responsible for the cost of a replacement shipment.
Please carefully verify your address before completing checkout.
SECTION 10 — LOST, DAMAGED OR STOLEN PACKAGES
Once an order has been shipped, the shipping carrier becomes responsible for transporting and delivering the package.
If your package arrives damaged, is lost in transit, or there is another carrier-related problem, please contact us.
If tracking shows that a package has been delivered but you cannot locate it, please:
- Check around your delivery location.
- Check with neighbors or other household members.
- Check your mailbox, parcel locker, porch, or other delivery locations.
- Allow additional time in case the carrier scanned the package early.
- Contact the applicable shipping carrier.
- Contact us if the package still cannot be located.
For packages confirmed as delivered, responsibility for the package may transfer to the recipient.
Package theft or confirmed delivery issues may therefore not automatically qualify for a refund or replacement.
We will review delivery problems on a case-by-case basis and determine the appropriate next step.
SECTION 11 — RETURNS OF COFFEE
Because our coffee is a freshly roasted, perishable food product, coffee cannot be returned for a standard refund or exchange.
Please do not send coffee back to us unless we specifically instruct you to do so.
Returned coffee cannot be resold and may need to be discarded.
If your coffee is incorrect, damaged, defective, or there is another problem with your order, contact us so we can review the situation.
SECTION 12 — ORDER ERRORS AND REPLACEMENTS
We distinguish between problems caused by the customer, problems caused by us, and problems caused by the shipping carrier or other circumstances.
Customer-caused errors
If a replacement is required because of an error made when placing the order or providing information — such as:
- Incorrect product information
- Incorrect shipping address
- Incorrect product selection
- Similar customer-related errors
—the customer is responsible for the replacement cost.
We will work to process the replacement as quickly as possible.
Black Ass Coffee Company or fulfillment error
If the wrong product, grind, label, or other item was sent because of an error in our fulfillment process, we will work to correct the problem.
Where applicable, the replacement coffee and shipping associated with the fulfillment error will be covered.
Carrier or other circumstances
If an issue results from the shipping carrier or another circumstance where neither the customer nor our fulfillment process is directly responsible, we will review the situation and determine the appropriate resolution.
Depending on the circumstances, a replacement may involve shipping costs being the customer's responsibility while the coffee cost is covered, subject to the applicable fulfillment arrangements.
Our goal is to resolve legitimate issues fairly while keeping the customer experience positive.
SECTION 13 — MERCHANDISE
Merchandise is subject to the applicable return, exchange, and product-specific terms displayed for the merchandise at the time of purchase.
If you have a problem with merchandise, contact us before sending the item back.
Please provide:
- Your order number
- Your name
- A description of the issue
- Photos when applicable
We will review the request and provide instructions for any applicable return, exchange, replacement, or refund.
SECTION 14 — INTERNATIONAL ORDERS
We currently do not ship internationally.
Orders are currently available only for destinations supported during checkout within the United States.
SECTION 15 — REFUNDS
When a refund is approved, it will generally be issued to the original payment method.
The time required for a refund to appear in your account may vary depending on your bank, credit card company, payment provider, or other financial institution.
If you believe you are entitled to a refund and have not received it, please contact us with your order number.
All refunds are subject to our applicable Return & Order Issue Policy.
SECTION 16 — INTELLECTUAL PROPERTY
All content available through our Services, including:

- Logos
- Trademarks
- Slogans
- Graphics
- Photographs
- Text
- Product descriptions
- Videos
- Designs
- Website content
is owned by Black Ass Coffee Company or its respective licensors and is protected by applicable intellectual property laws.
You may use our website for personal, lawful purposes.
You may not reproduce, copy, distribute, modify, sell, republish, transmit, or otherwise exploit our content without our prior written permission, except where permitted by law.
All rights not expressly granted are reserved.
SECTION 17 — CUSTOMER REVIEWS AND SUBMISSIONS
If you voluntarily submit reviews, comments, photographs, suggestions, ideas, testimonials, or other content to Black Ass Coffee Company ("Submissions"), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, modify, distribute, and otherwise use that content for business, marketing, promotional, and operational purposes.
You represent that:
- You own or have the necessary rights to the content.
- Your submission does not violate another person's rights.
- Your submission is not unlawful, fraudulent, misleading, defamatory, or abusive.
- Your submission does not contain malicious software.
We reserve the right to remove or decline to publish submissions where appropriate.
SECTION 18 — THIRD-PARTY SERVICES
Our Services may use third-party services and technology, including services related to:

- Order fulfillment
- Shipping
- Analytics

We are not responsible for the independent policies, availability, or performance of third-party services except to the extent required by applicable law.
SECTION 19 — SHOPIFY
Black Ass Coffee Company uses Shopify as its e-commerce platform.
Shopify provides the technology that enables us to operate our online store and process transactions.
However, the purchase of products through our store is a transaction between you and Black Ass Coffee Company.
Our products, fulfillment, customer service, returns, replacements, and other aspects of your purchase are our responsibility, subject to these Terms and applicable law.
SECTION 20 — THIRD-PARTY LINKS
Our website may contain links to third-party websites, platforms, or services.
These links may be provided for convenience and do not necessarily constitute an endorsement.
We are not responsible for the content, security, availability, policies, products, or services of third-party websites.
Your use of third-party websites is subject to their own terms and policies.
SECTION 21 — PROHIBITED USES
You agree not to use our Services for unlawful or unauthorized purposes.
You may not:
- Violate applicable laws or regulations.
- Commit or facilitate fraud.

- Our Services will always be uninterrupted.
- Our website will always be error-free.
- Product information will always be completely current.
- Every product will always be available.
- Shipping or delivery times will always meet estimates.
Nothing in these Terms is intended to exclude or limit any consumer protection rights or warranties that cannot legally be excluded or limited.
SECTION 24 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Black Ass Coffee Company and its owners, employees, contractors, service providers, affiliates, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our Services or purchase of our products.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
SECTION 25 — INDEMNIFICATION

- Your violation of applicable law.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
These Terms, together with our applicable policies, constitute the agreement between you and Black Ass Coffee Company regarding your use of our Services and supersede prior agreements concerning the same subject matter.
SECTION 28 — ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
Black Ass Coffee Company may assign or transfer its rights and obligations where permitted by law.
SECTION 29 — GOVERNING LAW
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
Any dispute arising from these Terms or your use of our Services will be subject to the applicable courts located in North Carolina, unless applicable law requires otherwise.
SECTION 30 — CHANGES TO THESE TERMS
We may update these Terms from time to time.
The current version will always be posted on this page with the applicable Last Updated date.
Where required by law, we will provide appropriate notice of material changes.
Your continued use of our Services after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.
